This Privacy Policy (the "Policy") describes how Hablio ("we", "our") collects, uses, stores, and protects the personal information of its customers, website visitors, and, in certain cases, the end users of its customers' services.

1. Data controller
The data controller responsible for personal data collected through habl.io is Hablio, with operating address in Bayamón, Puerto Rico, USA.

2. Information we collect
We collect information in the following categories:
- Account data: name, email address, phone number, company name, and password (encrypted) at registration.
- Usage data: pages visited, features used, clicks, session times, and server logs.
- Billing data: payment information processed securely through our certified payment providers (we do not store full card numbers).
- Message content: templates, text, and conversation data that the Client inputs into the platform to automate its communications.
- Technical data: IP address, browser type, operating system, device identifiers, and cookie data.
3. How we use your information
We use the information we collect to:
- Create and manage accounts, and provide the contracted Services.
- Process payments, issue invoices, and manage subscriptions.
- Send transactional communications (confirmations, security alerts, service notices).
- Improve, debug, and develop new platform features.
- Detect fraud, abuse, and activities that violate our Terms.
- Comply with legal obligations and respond to requests from competent authorities.
4. Legal basis for processing
We process your personal data on the following legal bases: (i) performance of the services contract between the Client and Hablio; (ii) Hablio's legitimate interest in improving the Services, detecting fraud, and ensuring security; (iii) compliance with legal obligations; and (iv) consent where required by law. California residents have additional rights under the California Consumer Privacy Act (CCPA), described in Section 9.
5. Who we share your information with
We do not sell, rent, or trade your personal information. We may share it only with:
- Service providers (sub-processors) providing infrastructure, storage (Vultr, Miami, FL), payment processing, analytics, and support services, under confidentiality agreements.
- Meta Platforms, Inc., to the extent necessary to operate the WhatsApp Business API integration.
- Legal authorities when required by law, court order, or to protect the rights of Hablio or third parties.
- Corporate acquirers in the context of a merger, acquisition, or asset sale, with prior notice to Clients.
6. Meta / WhatsApp Business API integration
Hablio's platform connects exclusively through Meta Platforms, Inc.'s official WhatsApp Business API. We share with Meta only the data strictly necessary to send and receive messages (recipient phone number, message content, and delivery metadata), in accordance with Meta's Terms of Service.
When the Client uses Hablio to send messages to its own contacts, the Client acts as the data controller for those contact data. Hablio acts as the Client's data processor for that traffic. The Client is responsible for obtaining opt-in consent from its contacts and complying with Meta's messaging policies.
7. Data security
We implement reasonable technical and organizational measures to protect your information against unauthorized access, loss, alteration, or disclosure. These include encryption in transit (TLS) and at rest, role-based access controls, and hosting on Vultr infrastructure in Miami, FL, USA. No system is 100% secure; in the event of a security breach affecting your data, we will notify you as required by applicable law.
8. Data retention
We retain your personal data for as long as your account is active and for any additional period necessary to fulfill legal obligations, resolve disputes, or enforce our agreements.
When you cancel your account, we retain your data for an additional 30 days to facilitate recovery or export. After that period, data will be permanently deleted or anonymized, except where legal retention requirements mandate a longer period.
9. Your rights
Depending on applicable law, you may exercise the following rights regarding your personal data:
- Access: request a copy of the personal data we hold about you.
- Rectification: request correction of inaccurate or incomplete data.
- Erasure: request deletion of your data under the conditions provided by law.
- Portability: receive your data in a structured, machine-readable format.
- Opt-out of sale (CCPA): California residents have the right to opt out of the sale of their personal information. Hablio does not sell personal data.

10. Children's privacy
The Services are intended exclusively for persons aged 18 and over. Hablio does not knowingly collect personal information from children under 13. If we become aware that we have collected data from a child under 13 without verifiable parental consent, we will delete that information immediately.
11. Cookies and tracking technologies
We use first-party and third-party cookies to operate the Site, remember your preferences, analyze traffic, and improve the user experience. Analytics cookies (e.g., Google Analytics) are subject to the privacy policies of their respective providers.
You can manage or disable cookies through your browser settings. Please note that disabling certain cookies may affect the functionality of the Site.
12. Changes to this Policy
We may update this Policy periodically. The current version will be published at habl.io/en/privacidad with the date of last update. For material changes, we will notify active Clients by email at least 15 days in advance. Continued use of the Services after the effective date constitutes acceptance of the updated Policy.
